JWS advises MM Capital Partners on acquisition of interests in Australian PPP projects

News Written by Johnson Winter Slattery

Leading independent law firm Johnson Winter Slattery (JWS) has advised MM Capital Partners on the successful acquisition by its latest fund, MM Capital Infrastructure Fund II, L.P., of 50 per cent interests in three Australian public-private partnerships (PPP) projects – Perth Stadium, Western Australia Schools and ACT Law Courts.

This is the new fund’s first investment into Australia. The acquisition of interests in these social infrastructure PPPs underscores MM Capital Partners’ continued investment focus on OECD countries, including Australia. MM Capital Partners currently has funds under management of more than A$660 million.

The JWS team advised on all tax aspects of the transaction and comprised lead Partner Matthew Shanahan and Senior Associate Jess Tsai. Partner Kathryn Bertram provided stamp duty specialist tax advice.

Commenting at the time of completion, Matthew Shanahan said, “Congratulations to MM Capital Partners on the successful acquisition. Our team here at JWS enjoyed working with MM Capital Partners again and it was great to be involved in yet another successful transaction involving iconic Australian assets. The sale was part of a competitive bid process, and we understand that there were many other parties interested in these assets. This is an excellent result for MM Capital Partners and Marubeni.”
