Internet, privacy and data – a year in review

In 2024, laws were passed which effect significant changes to regulation of the internet, privacy and data security in Australia. At the same time, Australian regulators such as the Privacy Commissioner made it clear that they are focusing on ensuring that those laws are more robustly enforced. Consequently, it is more important than ever for entities to map their relevant digital practices and ensure that appropriate compliance measures are in place. This article examines some of the key changes with a specific focus on: 

  1. online safety concerns: including those relating to children and young people, scams, misinformation and disinformation and other online consumer harms; 
  2. cyber security and data protection: including the recent reforms and cyber security incidents ; 
  3. artificial intelligence (AI): including consultation on proposed mandatory measures and further review being undertaken by the Australian Government; and
  4. other privacy developments: including the first tranche of privacy reforms and enforcement under the Spam Act 2003 (Cth).

2024 marked a distinct increase in regulation of the internet and of privacy in Australia. Changes will commence through the coming 24 months. It will be important for entities to understand the impact of these changes and put in place compliance measures in a timely manner. In an enforcement environment which includes a greater range of penalty provisions and enforcement-minded regulators, the risks of non-compliance will be substantial.
