Edwin Fah Special Counsel

Edwin is a litigation lawyer specialising in complex commercial disputes, with an emphasis on insolvency, and building and construction litigation.

Edwin has acted for large and medium sized businesses in superior Courts in each Australian State and the Federal Court.  He has also conducted appeals in the High Court. 

Accordingly, Edwin is adept at managing each stage of a dispute, from commencement through to final judgment and (if necessary) appeal. 

However, although Edwin is usually engaged once a dispute has arisen, he frequently advises clients on how to resolve matters prior to formal litigation occurring.

Edwin is a strategic lawyer, and is always focused on achieving commercial outcomes for his clients.

Separately, Edwin has been a:

  • committee member of the South Australian branch of the Asian Australian Lawyers Association since its inception in 2020;
  • committee member, since 2021, of the Law Society of South Australia’s:

Experience

General

Pirina and Naidenov, as liquidators of Fund Options Pty Ltd (In Liquidation)

Advised on the proper method of distributing the proceeds of a ponzi scheme where those funds were trust funds, were intermingled, and were subject to frequent withdrawals and deposits.

Donnelly and Anderson, as Administrators of NT Port and Marine Pty Ltd (Administrators Appointed)

Advised the Administrators in relation to the regulatory requirements of operating a security-regulated port on the Tiwi Islands. Obtained an order from the Court extending the convening period in relation to that company, and obtained a release from liability for the Administrators in relation to the repayment of funding obtained to operate the port.

Centuria Property Funds

Acted for Centuria in proceedings brought against the directors of its former corporate tenant for non-payment of rent and outgoings. Settlement was achieved at mediation for a substantial amount of the sum initially sought.

Equititrust Limited (Receivers and Managers Appointed) (In Liquidation)

Advised the Law Society of Queensland in relation to a fidelity fund claim made by the liquidators of Equititrust arising from allegedly unauthorised transactions involving a solicitor’s trust account.

Merkon Constructions Pty Ltd

Represented Merkon in proceedings involving the completion of a mixed use development involving defects and liquidated damages claims.
